The Australian Securities and Investments Commission (ASIC) is Australia's corporate and financial regulator. It oversees CFD and forex brokers operating in Australia, enforcing the Corporations Act and ASIC's own regulatory guidelines.
ASIC ensures brokers: hold an Australian Financial Services License (AFSL), maintain client funds in segregated trust accounts with Australian authorized deposit-taking institutions, adhere to product design and distribution obligations, and provide transparent disclosure of fees, costs, and risks.
Since October 2021, ASIC reduced retail CFD leverage to maximum 1:30 for major forex pairs and 1:20 for gold/minor pairs. This applies to all retail clients. Professional clients (certified with $250K+ assets or $1M+ annual income) can access higher leverage.
Search the ASIC Connect register at connectonline.asic.gov.au. Enter the broker's AFSL number or business name. Verify the license covers 'derivatives and foreign exchange contracts'. Check for any suspensions, conditions, or enforcement actions on the license.
ASIC mandates that retail client money must be held in a segregated trust account separate from the broker's operating funds. This protects your capital if the broker becomes insolvent. Some brokers also participate in professional indemnity insurance schemes for additional protection.
ASIC actively enforces compliance. Recent actions include fines for misleading advertising, license suspensions for inadequate risk management, and court proceedings for systemic failures. This active enforcement makes ASIC one of the most respected regulators globally for CFD trading.
Look for brokers with a valid AFSL that specifically covers CFD trading in commodities (gold). Check if the broker also holds licenses in other jurisdictions (dual regulation adds protection). Verify the broker's dispute resolution process — ASIC requires membership in the Australian Financial Complaints Authority (AFCA).
